    1. Introduction

    2. This Privacy Policy applies to all information received by TCT Ministries, Inc. (“TCT”), online and offline, including, but not limited to, our website, www.tct.tv, and all subdomains, web services, web applications, mobile applications, streaming media applications, all local or toll-free call and mail processing centers, all social media accounts held or operated by TCT (collectively “our Platforms”), job postings, prayer requests, praise reports, purchase orders, donations, pledges, and any other services (collectively, “our Services”) as well as any electronic, written, or oral communications made available or offered by our Platforms.

      TCT has adopted the privacy policies outlined below (this “Privacy Policy”), which serve as the basis for our use of Personal and Non-Personal Information gathered when interacting with TCT, including, but not limited to, utilizing our Platforms and/or our Services. This Privacy Policy is intended to comply with privacy laws applicable to TCT and the operation of our Platforms and Services.

      TCT is committed to upholding strong privacy protections for its users. Our Privacy Policy is intended to help you understand how we collect, utilize, and protect the information you provide us.

    3. Donor Information

    4. We will not sell, rent, trade, or otherwise share the names or Personal Information of our donors with any other entity without explicit permission from the donor. While we do use credit card or payment processing companies to bill for product orders and any charitable donations or pledges that you authorize or request; any Personal Information provided will only be used by such companies to perform their specific business functions and to provide services in support of our Platforms and/or Services, and as otherwise permitted by law in accordance with this Privacy Policy.

    5. Acceptance of Terms

By utilizing our Platforms or our Services, you agree to the terms of this Privacy Policy and Terms of Use and you consent to our collection, storage, use and disclosure of your Personal and Non-Personal Information as described in this Privacy Policy. You agree to review the Privacy Policy each time you use the Site so that you are aware of such modifications.

    7. The Information We Collect

    8. TCT collects the following types of information directly from you and indirectly through third-party service providers and advertising partners (collectively “our Partners”).

      1. Personal Information
      2. For the purpose of this Privacy Policy, Personal Information means any information or set of information that identifies or could be used by or on behalf of TCT to identify, a natural person, such as your name, address, and email address that you provide during registration on our Platforms and/or our Services. In general, the Personal Information you provide to us is used to help us communicate with you. Personal information does not include information regarding corporate entities or information that is encoded, aggregated, or anonymized, or publicly available information that has not been combined with non-public Personal Information.

        Examples of different purposes for which we may collect Personal Information include, but are not limited to, the following:

        • The registration process for our Platforms, events, product orders, newsletters, memberships, and partner sign-ups
        • Donations or pledges made to TCT or its affiliates
        • Job applications submitted to TCT or its affiliates
        • Voluntary submissions to our Platforms and/or Services requesting information about our products and services, signing up to receive information from us, sending us an email, prayer request and/or praise report
      3. Non-Personal Information
      4. In addition to Personal Information, we may collect additional information that does not personally identify you (i.e., “non-personal information”). This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to disclose such Non-Personal Information to our partners, advertisers, and other third parties at our discretion. If our Non-Personal Information practices change at any time in the future, we will post policy changes to our Platforms so that you may opt out of the new Non-Personal Information practices. Non-Personal Information may be collected as follows:

        • From Your Activity
        • This is information that we may automatically collect when you visit, access, or use our Platforms, including, but not limited to, your IP address, internet service provider, browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, which sections or features of our Platforms you visit, number of links you click while on a Platform, search terms used, operating system, and technical information about your client computing device. We may use a unique assigned number located with the website’s URL to determine each website from which you navigated to get to the TCT website. While this number may not be apparent to you, it does not contain your Personal Information.

        • From Cookies and JavaScript Code
        • This is information that we automatically collect using technical methods, including, but not limited to, cookies, JavaScript code, pixel tags, and other locally stored objects. Cookies are small packets of data that a website stores on your computer’s hard drive so that your computer will “remember” information about your visit. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to enhance your experience with our Platforms and to allow us to collect Non-Personal Information. If you wish to disable the use of cookies, you should take necessary steps within your web browser’s security settings to block all cookies from our Platforms. Please consult your web browser’s documentation for information on how to do this and how to delete persistent cookies. However, if you decide not to accept cookies from us, our Platforms may not function properly. We use JavaScript code to trigger a sequence of events that includes viewing a first-party cookie (or setting that cookie if it does not already exist) and to help us tailor and optimize your visit to our Platforms.

          Note: TCT assumes no responsibility for responding to Do Not Track (DNT) web browser signals. Consult external website polices regarding their response to DNT signals.

      5. Web Analytics
      6. TCT has entered into agreements with certain partners to deliver relevant, user-targeted, non-intrusive advertising to help promote TCT events and services. These partners do not have access to any Personal Information and only access to Non-Personal Information. They have their own policies that should be reviewed in connection with your use of our Platforms. Partners include, but are not limited to, Google Analytics.

        TCT uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help a website’s operator analyze how users use the site. The Non-Personal Information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers located around the world. Google will use this information for evaluating your use of the website, compiling reports on website activity for website operators, and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by them. You may refuse the use of cookies by selecting the appropriate settings in your web browser; however, please note that if you do this, you may not be able to use the full functionality of our Platforms. By using our Platforms, you consent to the processing of data about you by Google in the manner and for the purposes set forth above.

        Google Analytics collects information anonymously. It reports our Platforms usage trends without identifying individual visitors. You can opt out of Google Analytics without affecting how you use the Platforms.       7. The Information Collected by or Through Third-party Advertising Companies

We may share other information about your activity on our Platforms with third parties for tailoring, analyzing, managing, reporting, and optimizing the advertising you see on our Platforms and elsewhere. These third parties may use cookies, pixel tags (also called web beacons or clear gifs), or other technologies to collect other information for such purposes. Pixel tags enable us, and these third-party advertisers, to recognize a browser’s cookie when a user visits the site on which the pixel tag is located, in order to learn which advertisement brings a user to a given website.

    9. How We Use and Share the Information

    10. We use Personal and Non-Personal Information to process your donations or pledges, solicit your feedback, inform you about our products, events, and services, communicate information and ministry updates to you, and process product orders.

      We may also use or share Personal Information and other information as described below:

      • We may employ other companies and individuals to perform functions on our behalf. Examples may include providing technical assistance and marketing services. These other companies will have access to personal and other information only as necessary to perform their functions and to the extent permitted by law.
      • In an ongoing effort to better understand the needs and preferences of visitors to our Platforms, we may analyze other aggregate information and data in to operate, maintain, manage, and improve our company, products, and services. This aggregate information and data does not identify individuals personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics to describe our company, products, and services to current and prospective business partners and to other third parties for other lawful purposes.
      • We may share some or all Personal Information and other information with any of our parent companies, subsidiaries, or other companies under common control.
      • To the extent permitted by law, we may also disclose Personal Information and other information (a) when required by law, court order, or other government or law enforcement authority or regulatory agency, or (b) whenever we believe that disclosing such information is necessary or advisable (for example, to protect the rights, property, or safety of TCT, its affiliated entities, or members of the public).
      • We reserve the right to assign or transfer your Personal Information to any successor in interest to our organization associated with our Platforms or our Services by merger, reorganization, sale of all or substantially all of our assets or equity interests or operation of law. You will be notified via email and/or a prominent notice on our Platforms of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.
      • We also use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.

    11. Accessing and Modifying Information and Communication Preferences

    12. Upon request, TCT will grant individuals reasonable access to Personal Information that we hold about them. For example, visitors to our Platforms who have provided Personal Information to us may review and/or make changes to the same by contacting TCT. In addition, individuals may manage their receipt of marketing communications by clicking on the “unsubscribe” link located on the bottom of any TCT marketing e-mail, by following the instructions found on our Platforms, or contact us as described in the “How to Contact Us” section below. We will use commercially reasonable efforts to process such requests in a timely manner so that no further promotional communications will be sent to the email address or mailing address on file. You may, however, still receive transactional messages related to purchases, donations, or pledges. You should be aware, however, that it is not always possible to completely remove or modify information in our subscription databases.

    13. How We Protect the Information

    14. We take commercially reasonable steps to protect Personal Information and other information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. We use encryption, where possible, to keep your data private while in transit. We cannot guarantee that the information that you supply will not be intercepted while being transmitted to and from us over the public internet. Email sent to or from our Platforms may not be secure, and you should, therefore, take special care in deciding what information you send to us via email. Your account is protected by your password and we urge you to take steps to keep your Personal Information safe by not disclosing your password and by logging out of your account after each use.

      We review our methods of information collection, storage, and processing, including physical security measures, to prevent unauthorized access to our systems.

      We restrict access to Personal Information to necessary employees or contractors who need the information for processing. Anyone with this access is subject to strict confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations. We train these necessary employees on our privacy and security measures and applicable legal requirements.

      In the event that TCT transfers any Personal Information to third parties, we will use commercially reasonable efforts to assure that such third parties have knowledge of our Privacy Policy and provide sufficient protection of such Personal Information.

      Please note that, to provide secure credit card processing when ordering, donation or pledge requests and shopping cart orders placed on the Sites are processed through a payment gateway (such as Volusion and Donor Perfect) that operates under its own privacy policy. While TCT does store credit card information in secure location with limited access for donation or pledge purposes only, TCT primarily works with third parties to serve as a trusted intermediary to handle e-commerce transactions with our customers. Our commerce partners handle e-commerce on secure servers which encrypt all of our customers’ Personal Information.       While we take commercially reasonable steps to securely store the Personal Information we collect, we cannot guarantee 100% security. No transmission of data over the Internet is guaranteed to be completely secure. It may be possible for third parties not under the control of TCT to intercept or access transmissions or private communications unlawfully. When using our Platforms or our Services, any dispute over privacy is subject to this Privacy Policy, including but not limited to limitations of damages and application of the law of the state of Illinois and the laws, regulations, ordinances and treaties of the United States of America. BY USING OUR PLATFORMS AND/OR SERVICES, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO ASSUME THESE RISKS.

    15. Important Notice to Non-U.S. Residents

    16. It is important to note that our Platforms and their associated servers are located in the United States and other countries around the world. If you are located outside of the United States, please be aware that any Personal and Non-Personal Information you provide to us will be transferred to the United States. By using our Platforms and/or Services and by providing us information in any manner, you consent to this transfer and our use of the information and data provided by you in accordance with this Privacy Policy. We will investigate your question, respond to your inquiry, and attempt to resolve any concerns regarding your privacy question.

    18. Our Platforms and Services may contain links to third-party websites. TCT has no control over the privacy practices or content of those websites and is, therefore, not responsible for the content or the privacy policies of those websites. You should read and agree to the applicable Privacy Policy when visiting any other website.

    20. Our Platforms and/or Services are not directed to anyone under the age of 13 and we do not knowingly solicit or collect Personal Information from anyone under the age of 13.

      IF YOU ARE UNDER THE AGE OF 13 YEARS, PLEASE DO NOT PROVIDE US WITH ANY PERSONAL INFORMATION.

      WE ENCOURAGE PARENTS AND LEGAL GUARDIANS TO MONITOR THEIR CHILDREN’S INTERNET USAGE AND HELP ENFORCE OUR PRIVACY POLICY BY INSTRUCTING THEIR CHILDREN NEVER TO PROVIDE PERSONAL INFORMATION WITHOUT THEIR EXPLICIT PERMISSION AND SUPERVISION.

      If you have reason to believe that a child under the age of 13 has provided Personal Information to us without parental permission, please contact us, and we will endeavor to delete that information from our databases.

    21. California Residents

Under California Civil Code Section 1798.83, California residents who have an established business relationship with TCT may choose to opt out of our sharing of your Personal Information with third parties for direct marketing purposes. If you are a California resident and wish to (a) opt out or (b) request certain information regarding our disclosure of your Personal Information to third parties for direct marketing purposes, please contact us as described in the “How to Contact Us” section below.

    23. Changes to This Privacy Policy

    24. This Privacy Policy is effective as of the date stated on this policy. We reserve the right to change this Privacy Policy and our Terms of Service at any time. Please refer to it on a regular basis. Be aware that, to the extent permitted by applicable law, our use of Personal Information and other information is governed by the Privacy Policy in effect at the time we collect the information.

    2. The TCT website and platforms are designed to meet the principles of the GDPR. Here are some of the actions we’ve taken to ensure our compliance with GDPR:

      • We limit the personal data we collect;
      • We have established a legal basis for the processing of that data;
      • We only retain personal data for a limited time period, after which, the data is deleted

    6. If you provide information to us, we will keep that information for up to twelve months after your last communication with us.

      We will keep personal information provided by our users for up to three months after the end of our business relationship and subject to our Software as a Service (“SaaS”) provider agreement. All payment information will be deleted three months after processing, unless we are required by law to keep it longer.

      If you contact us directly using the contact information provided on the TCT website, we will retain your contact information for a period of up to three months after we respond to your inquiry. After that, the communications will be deleted from our system, unless we are required by law to retain it longer.

    8. Note that our Platforms and/or Services are not directed to anyone under the age of 13 and we do not knowingly solicit or collect Personal Information from anyone under the age of 13.

    10. If you are a user of the TCT website or platform located in the EEA, we rely on legitimate interest as the basis for processing the personal data we collect via the website and platform.

    12. Depending on which features you choose to use, TCT, is both Controller and Processor of personal data covered by the Privacy Policy for purposes of European data protection legislation.

      In connection with the operation of our website, TCT may engage third parties (each a “Sub-processor”) to process your personal data. As a condition of permitting a Sub-processor to process your personal data, TCT will enter into a written agreement with each Sub-processor containing data protection obligations at least as protective as the technical and organizational measures TCT has put into place to protect your personal data from accidental or unlawful destruction, loss, alteration, or unauthorized disclosure or access.

    13. International Data Transfers
    14. If you are located within the EEA when you visit the TCT website or log in to the TCT SaaS platform, we may transfer your personal data outside of the EEA. When we do, we will ensure that an adequate level of protection is provided for the information by using industry-standard encryption at rest and in transit.

      For visitor facing components of the platform such as TCT’s consent manager, all personal data is stored by Amazon Web Services in Dublin, Ireland, within the EEA.
